1. Software only

Popurise Pty Ltd (“Popurise”) provides software, tooling, templates and modelling outputs only (the “Service”). The Service is a calculation and modelling tool. It is not a financial product, financial service, investment platform, valuation service, lender, broker, adviser, planner or other professional service. Popurise does not act as your agent, fiduciary, adviser or representative.

2. No professional advice

Nothing made available through the Service, including any default, benchmark, template, input, assumption, calculation, output, scenario, report, example, sample, content, response or communication, constitutes:

  • financial product advice or financial advice of any kind;
  • investment advice or a recommendation to acquire, hold or dispose of any property, security, financial product, financing arrangement or interest;
  • valuation advice or any opinion of value, market value or fair value;
  • taxation advice or guidance on any tax position, treatment or liability;
  • legal advice;
  • planning, town planning, zoning, environmental, heritage, building or engineering advice;
  • lending, credit, mortgage or finance broking advice;
  • accounting, audit, assurance or bookkeeping advice;
  • real estate, agency or buyer’s advocacy advice; or
  • any other professional advice or recommendation.

3. Outputs depend on your inputs and assumptions

Every output, calculation, scenario, cashflow, residual, return and report produced by or through the Service is generated from inputs, assumptions, defaults, settings, sensitivities and Customer Data selected, provided or accepted by you. Outputs are sensitive to those inputs and assumptions and will change as they change. You are solely responsible for the accuracy, completeness, currency and suitability of all inputs and assumptions, and for the appropriateness of any defaults, templates or sample data you choose to rely on.

4. No guarantee

To the maximum extent permitted by law, Popurise does not warrant, guarantee or represent the accuracy, completeness, reliability, currency, suitability, availability or performance of the Service, or of any data, default, benchmark, template, input, assumption, output, scenario, calculation, model, report or content. Popurise does not guarantee any specific result, outcome, profitability, feasibility, financing, approval, market value, sale price, rental income, yield, return, exit, performance, project success, development outcome or investment result.

5. Independent verification required

Before relying on any output of the Service, you must independently verify all relevant inputs, assumptions, calculations, sensitivities, outputs, scenarios, reports and analyses, including by reviewing source data, conducting your own due diligence, and obtaining your own qualified professional advice. You must also satisfy yourself that the Service is fit for your intended purpose, jurisdiction and use case.

6. Obtain professional advice

You must obtain your own qualified professional advice, including legal, financial, investment, valuation, taxation, accounting, planning, engineering, construction, environmental and town planning advice, and any other advice relevant to your circumstances, before making any acquisition, bid, financing, investment, development, sale, hold, exit, leasing, planning, lending, credit or other decision.

7. Not the sole basis for any decision

The Service must not be used or relied on as the sole, primary or determinative basis for any decision. Decisions to acquire, bid for, finance, develop, hold, sell, exit, lease, lend on, invest in or otherwise transact in any property, site, project, security or arrangement are your decisions alone, made on your own information, advice and judgement.

8. No reliance on outputs

You agree not to rely on any output of the Service. Outputs may contain errors, omissions, inaccuracies, bugs, defects or out-of-date information, and may be incomplete, inappropriate for your circumstances or inconsistent with current market conditions, regulations or accounting, valuation or financial standards.

9. Forward-looking statements and projections

Any forecast, projection, scenario, sensitivity or forward-looking statement in or produced by the Service is hypothetical, illustrative and subject to material uncertainties, assumptions and risks. Actual outcomes will differ, may differ materially, and may be more or less favourable than projected.

10. Third-party data and references

The Service may incorporate or reference data, benchmarks, defaults, content or links from third parties. Popurise does not endorse, verify, audit or guarantee any third-party data or content and accepts no responsibility for it. You must independently verify any third-party data before relying on it.

11. Beta and early-access features

Any beta, preview, early-access or experimental feature is provided as-is and as-available, may be modified or withdrawn at any time, and must not be relied on for any decision.

12. No liability for losses from reliance

To the maximum extent permitted by law, Popurise, its related bodies corporate, officers, employees, contractors, agents and licensors are not liable for any loss, damage, cost or expense arising from or in connection with your reliance on the Service or any output of the Service, including any loss of profit, loss of revenue, loss of opportunity, loss of contract, loss of deal, loss of bid, loss of financing, loss of investment, loss of development outcome, loss of data, reliance loss or any indirect, consequential, incidental, special or punitive loss, however arising and whether in contract, tort (including negligence), under statute or otherwise. Limitations on Popurise’s liability are set out in full in our Terms of Service.

Nothing in this disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
